Student Conduct Appeal Form


This form is for Student Code of Conduct (Regulation 4.007) Appeals only.
Exceptional Circumstance Withdrawal (ECW) Appeals must be filed through the ECW Appeal Form.

Appeal Instructions and Process

Instructions for the Appeal Form:

 

  1. The Appeal Form and any supporting documents must be completed and typed by the individual student.
  2. The reason(s) for appeal must be selected on the Appeal Form.
  3. If appealing a decision made through the Code of Conduct process, the individual student must submit the Appeal Form electronically and will receive the appeal decision letter via your FAU email account.
  4. Upon electronic submission, the Appeal Form will be sent to Dr. Larry Faerman, Vice President for Student Affairs, for review.
  5. The Appeal form should not be submitted to the Associate Vice President and Dean of Students office.
  6. The Appeal Form must be received in correspondence within five (5) business days of the date of receipt of Notice of Decision and Sanction letter. Late appeals with NOT be accepted.



Appellate Review Process:


A student may appeal the decision of the Associate Vice President and Dean of Students (as to whether the student has been found responsible or not responsible through a hearing) and/or the sanctions imposed by the Associate Vice President and Dean of Students or Conduct Administrator.


    1. Reasons to appeal are:
      • Failure to receive the minimum requirements of process, as described under this Regulation, or a procedural irregularity that affected the outcome of the matter.
      • Severity of the sanction
      • New evidence that was not reasonably available at the time the determination regarding responsibility or dismissal was made, that could affect the outcome of the matter.
      • In Title IX matters, The Title IX Coordinator, investigator(s), or the Student Conduct Board of University Hearing Officer had a conflict of interest or bias for or against Complainants or Respondents generally or the individual Complainant or Respondent that affected the outcome of the matter.

 

    1. The burden of proof at the appellate level rests with the charged student.

 

  1. The appeal determination of the Vice President for Student Affairs or designee is final and binding on all parties. There are no further appeals within the University. The student has the right to appeal the University's final decision to an external judicial forum.
